  1. LICENSING INFORMATION

  3. The TCP/IP Scripting Addition is now managed by Mango Tree Software. Mango
  4. Tree Software is not a big faceless corporation; on the contrary, Mango Tree
  5. Software is just me, the author. I have come up with the following
  6. distribution scheme to promote use and distribution of the TCP/IP Scripting
  7. Addition:

  9. 1. If you use the TCP/IP Scripting Addition for PURELY personal use, the
  10. licensing fee will be free. You may use the unregistered version.
  11.  
  12. 2. If you use the TCP/IP Scripting Addition to help with ANY task in your
  13. business or company or university, or in an in-house product, the licensing
  14. fee is $20 per copy, or $200 for a company site-wide or university-wide site
  15. license (including students).

  17. 3. If you use the TCP/IP Scripting Addition as part of a product you
  18. distribute for a charge, or part of a solution you provide as a consultant,
  19. the licensing fee is $500 per year for unlimited distribution (you make the
  20. disks and print the documentation, if necessary).  You will need to reproduce
  21. the copyright notice on all copies of the TCP/IP Scripting Addition. This
  22. charge includes the $200 mentioned in the previous paragraph, so that you (or
  23. your business single-site, company single-site, or university) can also use
  24. the TCP/IP Scripting Addition to assist with in-house tasks. For your
  25. customers or clients who receive the TCP/IP Scripting Addition through your
  26. distribution, this charge grants them world-wide permission to use the TCP/IP
  27. Scripting Addition only with your application. Any other use by your
  28. customers or clients requires the license described in the previous
  29. paragraph.

  31. 4. If you would like a non-exclusive world-wide source code license for the
  32. TCP/IP Scripting Addition version 1.1, the fee is $5000. The source source
  33. code is commented and is written using MPW C.
  34.  
  35. 5. If you use the TCP/IP Scripting Addition as part of a FREE or SHAREWARE
  36. product, contact me first for permission.  In most cases, the licensing fee
  37. will be free, or a portion of your shareware fee.
  38.  
  39. 6. If you want to include the TCP/IP Scripting Addition as part of a CD
  40. collection of software, contact me first for permission and further
  41. information.
  42.  
  43. For sales in Rhode Island, I am required to add 7% sales tax.
  44.  
  45. If you pay a licensing fee, you will receive AppleScript 1.1 and the FaceSpan
  46. Extension (under license from Apple Computer, Inc.) if desired, along with
  47. the latest version of the TCP/IP Scripting Addition.
  48.  
  49. My plan is to provide those who pay for the Scripting Addition with newer
  50. versions and additional features, including automatic BinHex or AppleSingle
  51. file transfers, additional debugging support, PowerPC native code versions,
  52. and enhanced server commands.  I will also provide limited support for
  53. registered users through Internet e-mail. YOU will know whether this
  54. scripting addition saves you time and money; if it does, I am counting on you
  55. to continue to support further development by sharing some of these savings
  56. with the author and paying the licensing fees.

  58. Two licensing agreements and an order form should have been included in this
  59. package. The licensing agreements are for individual and site–licenses. If
  60. you have any questions regarding licensing, or wish to set up one of the
  61. other types of licensing agreements mentioned above, please call me at

  64. Upon receiving an order form, signed licensing agreement and a check, I will
  65. send you the latest version and add you to the mailing list for future
  66. versions.

  82. The software package is provided to you on an 'as is' basis without warranty
  83. of any kind, either expressed or implied. Licensor (Mango Tree Software) does
  84. not warrant, guarantee, or make representations regarding the use, or the
  85. results of the use, of the Software Package (TCP/IP Scripting Addition) with
  86. respect to its correctness, accuracy, reliability, currentness or otherwise.
  87. The entire risk as to the results and performance of the Software Package is
  88. assumed by the Licensee (you). Licensor makes no express or implied
  89. warranties including, but not limited to the implied warranties of
  90. merchantibility and fitness for any particular purpose, or arising from a
  91. course of dealing, usage, or trade practice, with respect to the software
  92. package. Licensor shall not be liable for any claim, liability, damages,
  93. costs and expenses (including but not limited to attorney fees and costs of
  94. suit), or other loss caused, suffered, or incurred by Licensee arising from
  95. Licensee's use of the Software Package. In no event shall Licensor be liable
  96. for any loss or damage that may arise in connection with the furnishing,
  97. performance or use by Licensee of the Software Package, including, without
  98. limitation, any direct, indirect, special, incidental or consequential
  99. damages. In no event shall Licensee be entitled to any monetary damages
  100. against Licensor in excess of the license fees paid to Licensor by Licensee
  101. hereunder for the Software Package to which Licensee's claim relates.
